 Terms and Conditions

 

This Competition is intended for viewing and participation in the Republic of Ireland only and these terms and conditions shall be construed and evaluated according to the laws of Ireland. Please do not proceed if you are not an Irish resident] at time of entry. Void elsewhere and entry prohibited.

A valid e-mail address and facebook account is required to participate in the Competition.

These terms and conditions apply to the BEN’S BEGINNERSTM Competition. By entering the Competition, you accept and agree to be bound by these terms and conditions. If you do not accept them, you are not eligible to participate in the Competition.

The purpose of this competition is to promote parents cooking with their children as a means of teaching them better eating habits for life. Cooking with your children makes for a great beginning.

      SPONSORSHIP. The BEN’S BEGINNERSTM Competition is sponsored by Mars Ireland (Sponsor). This Competition is in no way sponsored, endorsed or administered by, or associated with Facebook and Entrants understand that by entering the Competition, they are providing their information to Sponsor and not to Facebook. Facebook is completely released of all liability by each Entrant. Any questions, complaints or comments regarding the Competition must be directed to Sponsor and not to Facebook.

 

      Competition PERIOD: The BEN’S BEGINNERSTM Competition (the “Competition”) commences on Monday 7th October 2013 at 0:01, and closes on Sunday 3rd of November 2013 at 10:00 (the “Competition Period”).

 

3. ELIGIBILITY: The Competition is only open to  residents of the Republic of Ireland  are resident and present in Ireland at the time of entry, and have a valid email address. Individuals who are a director, officer, or employee, of Mars Ireland or its subsidiaries and associated companies, advertising and competition agencies, the independent Competition Judges (collectively the “Competition Entities”), or a member of the immediate family (defined as mother, father, brothers, sisters, sons, daughters and husband or wife) of any of the above persons, are NOT eligible to participate in the Competition.

 

4. HOW TO ENTER:

To enter, visit https://www.facebook.com/unclebensireland during the Competition Period and click on the “BEN’S BEGINNERSTM” app tab on the Facebook page. Alternatively, entrants may upload the photo or video to the Facebook Wall. You must have or obtain a Facebook account to participate. In order to access the Competition application (the “Application”) you will need to ‘”LIKE” the Uncle’s Ben’s page and allow the Application to access your Facebook account by clicking “ACCEPT” permissions. Once on the app landing page, Click on the ‘UPLOAD HERE’ button, which will bring up the ‘MY UPLOAD’ section. Choose whether you want to upload a photo or a video. Fill in the entry form. Review the  Terms and Conditions. If you agree, accept them as read and understood by ticking the button next to the sentence ‘I accept the terms and conditions’.

You must confirm the following for the video you are about to load:

      that the Video OR photo is original and of your own creation;

      that you have obtained all required consents;

      that you consent to the Video being posted to the UNCLE BEN’S Ireland Facebook page and the Competition Site, and/or used to promote the Competition in regular media including broadcast media, for as long as the website and/or Facebook page remain active, including after the end of the Competition Period;

      that you agree to the editing/modification/alteration/removal of the Video; and

      that you agree to be named or not named as the owner/creator of the Video at the Sponsor’s sole discretion,

Then click on the ‘SUBMIT’ button.

If you choose to upload a photo, you must confirm the following for the photo you are about to upload:

            that the photo is original and of your own creation;

            that you have obtained all required consents;

that you consent to the photo being posted on the Irish UNCLE BEN’S website of Ireland, uploaded to the UNCLE BEN’S Ireland Facebook page and the Competition Site, and/or used to promote the Competition  in regular media, for as long as the website and/or Facebook page remain active, including after the end of the Competition Period; 

that you agree to the removal of the photo and

that you agree to be named or not named as the owner/creator of the photo at the Sponsor’s sole discretion,

Then click on the ‘SUBMIT’ button.

Upload a video/photo you would like to submit for the Competition and click the “ENTER” button. Video must meet the criteria outlined below.

 

Video Requirements

      Video may not exceed three (3) minutes in length or a 100MB maximum file size

      Video must be in one of the following formats: .MOV, MPEG4, .WMV, .FLV or AVI and be of sufficient video and audio quality to enable public voting and judging, in Sponsor’s sole discretion.

      Video must show You and Your Child who must be between the ages of 5 – 12 at time of entry (Child) preparing a recipe that includes an UNCLE BEN’S® rice product. The recipe must not be one that has previously won a prize or award.

      You and Your Child should be the focal point of the Video.

      While shooting the Video, You may introduce both You and Your Child (you must use your Child’s first name only). After the introduction, You or Your Child should introduce the dish that he or she is preparing.

      The content of the Video:

         Must not violate or infringe the rights of others including, without limitation, patent, trademark, trade secret, copyright, publicity, privacy or other proprietary rights;

         Must not be unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortious, contain explicit or graphic descriptions or accounts of sexual acts, or otherwise contain any content that is or can be considered to be inappropriate, unsuitable, objectionable or offensive, all as determined by the Sponsor in its sole and absolute discretion;

         Must not victimise, harass, degrade, or intimidate an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;

         Must comply with these terms and conditions ;

         Must not contain any advertisement or solicitation not affiliated with the Sponsor;

         Must not contain any musical recording or compilation; and

         Must not contain imagery, content, recording or any other element that is owned by a third party or that is associated with a competitive product to the UNCLE BEN’S® brand.

 Photo Requirements

      Photos may not exceed a 100MB maximum file size

      Photo must be in one of the following formats: JPEG, PDF, PNG, GIF and be of sufficient quality to enable public voting and judging, in Sponsor’s sole discretion.

      Photo must show You and Your Child who must be between the ages of 5 – 12 at time of entry (Child) with the final UNCLE BEN’S® rice meal. The recipe must not be one that has previously won a prize or award.

      You and Your Child should be the focal point of the Photo.

      The content of the Photo:

         Must not violate or infringe the rights of others including, without limitation, patent, trademark, trade secret, copyright, publicity, privacy or other proprietary rights;

         Must not contain any advertisement or solicitation not affiliated with the Sponsor and

         Must not contain imagery, content, or any other element that is owned by a third party or that is associated with a competitive product to the UNCLE BEN’S® brand.

 

To be eligible, Entries must be received prior to the end of the Competition Period.  Entries that are received after the end of the Competition  Period will not be eligible. 

 

All Entries submitted will be reviewed by Sponsor and/or its promotional agency to ensure that they qualify in accordance with the Terms and Conditions, including the Video and Photo Requirements outlined above. Sponsor reserves the right to disqualify any Entry that it determines in its sole and absolute discretion not to be in compliance with the terms and conditions or that does not meet the Video or Photo Requirements. Entries may be disqualified if the Video or Photo is damaged, corrupt, unplayable, incomplete, of poor video or audio quality, or otherwise deemed insufficient or unacceptable for public viewing and voting and for judging, in the Sponsor’s sole discretion.

 

 

LIMIT OF ONE (1) ENTRY PER HOUSE HOLD FEATURING THE SAME CHILD, OR UP TO FIVE (5) UNIQUE ENTRIES PER HOUSEHOLD (EACH FEATURING A DIFFERENT CHILD). Any additional Entries submitted will not be eligible or otherwise considered by the Sponsor.

 

5. PRIZES:

There is a total of one (1) grand prize available to be won in the Competition:

The winner shall receive €5,000 cash prize for their family as well as a €10,000 cash donation towards healthy initiatives for the winning child’s school.

In no event will the Sponsor be liable for more than the number and value of Prizes described above.

 

6. EVALUATION OF VIDEOS

There will be five (5) phases in the evaluation process, as follows:

Phase 1: Entry and Initial Review.  Each Entry that is submitted to the Competition Site will first be evaluated by the Sponsor or its agency. If the Entry complies with these Terms and Conditions and the Video and Photo Requirements, the Sponsor will post the Video or Photo on the Contest Site. An email will be sent to the Entrant's email address to confirm entry; however, this email may not be sent until after the Video or Photo has been posted. If at any time during either of the voting periods described below, the Sponsor determines that a Video or Photo fails to meet the Video or Photo Requirements in paragraph 4 above or is otherwise not in compliance with these Terms and Conditions, Sponsor may remove the Video or Photo from the Contest Site.

 

Phase 2: Public Voting Period 1. During the period from 7th October 2013 at 0:01 to Sunday 3rd of November 2013 at 10:00] (" Public Voting Period 1"), the public will have an opportunity to review the Videos and Photos posted on the Competition Site. When the competition closes on the 3rd of November each person who has or obtains a Facebook account may cast a maximum of one (1) vote (Vote) for each Video or Photo that he or she feels is reflective of the spirit of the spirit and theme of the Competition. Voting can take place between Sunday the 3rd of November and Thursday the 14th of November. Limit one (1) Vote per Voter per Video and Photo. For greater certainty, a Voter may cast a Vote for more than one Video or Photo on the same day, but may not vote for the same Video or Photo more than once in the Public Voting Period. Voters must be over the minimum age required to create a Facebook account and otherwise comply with Facebook account creation rules in order to vote. Votes must be recorded by the Sponsor's server by Thursday the 14th of November at 10:00. If it is discovered that attempts were made by a Voter to (i) vote more than once for a Video or Photo, or (ii) to use automated, script, macro or robotic programs to submit Votes or (iii) to engage in systematic voting from the same computer/IP address, the Voter’s past Votes and any future Votes may be cancelled and not counted, in the sole and absolute discretion of the Sponsor. All Votes are subject to verification. The Sponsor reserves the right to require a Voter to provide proof of identity and/or qualification under these Terms and Conditions for Votes cast or purportedly cast by such Voter to be considered valid for the purposes of this Competition.

 

Phase 3: Judging Period. Following the Public Voting Period 1, a panel of judges comprising employees of Sponsor, its agency and/or Ambassador (Neven Maguire) will evaluate each of the Videos and Photos posted on the Competition Site to select four (4) Videos / Photos as potential Finalists. The potential Finalists will be chosen based on the following criteria:

                                The total number of Votes that the Videos received during the Public Voting Period 1.

                                    Availability of finalists (both parent and child) to come to Dublin on Monday 18th November to prepare their Uncle Ben’s rice dish for Neven Maguire and have the segment filmed (with full approval) for both the Uncle Ben’s Ireland Facebook and to be broadcast on the RTE Today Show.  All reasonable pre-agreed expenses (travel) will be covered by Sponsor.

The four potential Finalists will be notified on the Facebook page by the denotation of a ‘Finalists badge’ on their entry in the Gallery section of the application on Friday, 15th November 2013.

 

Phase 4: Final Judging. The Judges will evaluate the four (4) Finalist Videos to determine one (1) Grand Prize. The final judging period will occur between the dates of 23rd and 28th November 2013. The four (4) Finalist Entries will be judged based on the following criteria:

              Personality and ability of Parent and Child to engage and inspire the audience (50%)

              Creativity of rice meal cooked (50%)     

 

The Judges will give each Finalist Video a score based upon the criteria and percentage weight listed above. The Finalist with the highest score will be chosen as a potential Grand Prize Winner.

 

The potential Grand Prize Winner will be notified by email on Thursday, 28th November 2013 and will be required to execute and return additional Prize Acceptance documents and/or liability waivers. If Prize Acceptance documents and/or liability waivers sent to the potential Grand Prize Winner are not deliverable, or if the potential Grand Prize Winner is found to be ineligible or not in compliance with these Terms and Conditions, does not respond within the time period specified, or refuses to accept the terms and conditions of being a Grand Prize Winner, the potential Grand Prize Winner will be disqualified and the next highest scored Finalist in the Phase 4 Final Judging will be awarded the Grand Prize in place.

 

The Grand Prize Winner must be available to travel to the RTE Today Show in Cork for a personal appearance week commencing Monday, 2nd December. All reasonable pre-agreed expenses (travel) will be covered by Sponsor.

 

7. GENERAL:

         By entering the Competition, Entrants agree, and by voting in this Competition, Voters agree to abide and be bound by these terms and conditions and decisions of Sponsor and the Judges, which are final and binding on all Entrants and Registered Voters with respect to all aspects of the Competition.

         The Sponsor is not responsible for typographical errors or any other errors in the offer or administration of this Competition, whether human, mechanical, clerical, electronic, or technical in nature, including but not limited to errors in advertising materials and the Terms and Conditions.

         In the event of a conflict between Competition  details contained in these Terms and Conditions  and Competition details contained in Competition  advertising (including but not limited to online, point of sale, and print advertising, packaging, and other Competition media), the details of the Competition as set forth in these Terms and Conditions shall prevail.

         All Prizes must be accepted as awarded. Sponsor reserves the right to substitute a Prize(s) of equal or higher value at its sole discretion. Any portion of a Prize(s) that is unused or which is not used according to these Terms and Conditions will be forfeited and will have no cash value.

         All Entries become the property of Sponsor and will not be returned. By entering the Competition, each Entrant agrees to the use of his/her name, address, photograph or other likeness, his/her Child’s first name and photograph or other likeness, their recipe and Video or Photo, as well as his/her and his/her Child’s appearance at publicity events, without any additional compensation and as required by the Sponsor if he/she is declared a Winner. Winners will be required to sign a publicity release to this effect.

         Sponsor accepts no responsibility for lost, stolen, deleted, delayed, late, damaged, corrupt, misdirected, incomplete, unrecorded, unplayable or illegible Entries, Votes, Finalist Documents, Prize Acceptance Documents or any failure of the Competition  Site or any related website during the Competition Period, or for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an Entrant’s or Voter’s or any other person’s computer related to or resulting from entering or voting in the Competition or downloading any material relating to the Competition. Proof of transmission does not constitute proof of delivery.

         The Sponsor reserves the right to disqualify any Entrant’s Entry in the Competition (and void all associated Entries) or entitlement to a Prize, if, in the sole discretion of the Sponsor, they determine or suspect that the Entrant has attempted to undermine the legitimate operation of the Competition  by cheating, hacking, deception, or other fraudulent, deceptive or unfair practices (including any Entries or Votes generated by script, macro, robotic, programmed, or any other automated means).

         In the event of a dispute as to the identity of an Entrant, Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorised account holder" is defined as the natural person assigned to an e-mail address by an Internet service provider, online service provider, or other organisation responsible for assigning e-mail addresses for the domain. Potential Winners may be required to show proof of being the authorised account holder for that e-mail address.

         Any attempt to deliberately damage any web site or to undermine the legitimate operation of this Competition, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. Any Entrant engaging in any of the foregoing activities may be disqualified and will forfeit any Prize. 

         As a condition of entering, each Entrant and as a condition of voting each Voter agrees: (a) to release Sponsor and Contest Entities, and each of their officers, directors, employees and agents, from any and all liability, loss or damage incurred with respect to participation in the Competition or the awarding, receipt, possession, and/or use or misuse of any Prize , (b) that under no circumstances will Entrant be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Contest, or any Prize awarded, shall be resolved individually; and (d) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, excluding legal fees and court costs.

         The Sponsor reserves the right to suspend, cancel or modify the Competition at any time, for any reason, including fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of Sponsor, that corrupt the administration, security, integrity or proper play of the Competition.

         This Competition is exclusively governed by and construed in accordance with the laws of Ireland.

By entering the Competition, Entrants and Registered Voters consent to the collection and use of their personal information as per the privacy policy found under the heading “Privacy” on the UNCLE BEN’S ® brand website www.unclebens.co.uk.
